Arizona lawmakers on Tuesday approved what foes and supporters agree is the toughest measure in the country against undocumented immigrants, making it a crime to be an illegal immigrant in Arizona and allowing local police to determine whether people are in the country legally.

The measure, long sought by opponents of illegal immigration, passed in the state House of Representatives. The state Senate passed a similar measure earlier this year, and Republican Gov. Jan Brewer, who has not spoken publicly about the issue, is expected to sign the bill.

The bill’s author, State Sen. Russell Pearce, said the law simply “takes the handcuffs off of law enforcement and lets them do their job.”

But police were deeply divided on the matter, with police unions backing it but the state police chief’s association opposed the bill, contending it could erode trust with immigrants who could be potential witnesses.

Immigrant rights groups were horrified, and contended that Arizona had just been transformed into a police state.

“It’s beyond the pale,” said Chris Newman, legal director of the National Day Laborer Organizing Network. “It appears to mandate racial profiling.”

The bill prevents any government agency from formulating policies to prevent enforcement of immigration laws and permits citizens to sue if they believe a law enforcement agency is failing to enforce the law.

It requires law enforcement officers who have a “reasonable suspicion” that someone is an illegal immigrant to determine that person’s immigration status “when practicable.” Previously, police who wanted to inquire about immigration status could only do it after stopping people for possibly violating other laws.

A provision in the bill states that race or ethnicity cannot be the sole grounds for asking about immigration status, but civil rights groups note that authorities are not barred from using them along with other factors that raise suspicions.

The measure also makes it illegal to solicit work as a day laborer or to hire day laborers.

Our criminal justice system is broken! But that isn’t exactly news. We have all known for some time that serious problems exist. What has kept us from being collectively outraged and demanding immediate reform is because until it affects you, it’s a lot like the weather: “Everybody complains about it, and no one does anything”. We as individuals have no way to assess the magnitude of the problem until it touches us personally; through a friend, or family member, or, God forbid, we find ourselves firmly planted in its arbitrary and ruinous crosshairs ourselves. Unfortunately, by the time that happens it is generally too late. Here in the Oregon, like every other state, we no longer try cases…we negotiate convictions. And that is not how the system was designed to work.

We have all heard the stories that are symptomatic of this break down:

• Like the one where the High School football player flashes a BA (bare ass) from the team bus as it rolls out of the parking lot and is now a registered sex offender; required to register for life, forever stamped as one of societies biggest, most unwelcome, pariahs. His life ruined.

• Or the innocent man wrongly charged with a crime who now finds himself willing to accept a plea bargain and agreeing to serve a prison term before availing himself to a trial by a jury of his peers, the numerous mandatory minimum sentences widely used and abused by prosecutors, and our current criminal justice system.

• The list goes on and on!

That is not to say that the current system’s all inclusive ‘dragnet” , doesn’t take bad guys off the streets too…it does. The credibility flaws in our system today are primarily due to the fact that in doing so it also takes a wholly unacceptable number of good guys off the streets in the process. U.S. Supreme Court Justice Edward D. White said it best when he quoted a Roman official who wrote that “it was better to let the crime of a guilty person go unpunished than to condemn the innocent.” Nevertheless, we know that a fallible system like ours is doomed to generate false acquittals as well as false convictions. Given the volume of crime and the pressure to solve cases, too often police officers take the easy way out. Once they come to suspect someone as the culprit, and this often occurs early within the investigation and is based on rather flimsy circumstantial information, then the investigation blindly focuses in on that adopted “target.” Crucial pieces of evidence are overlooked and disregarded. . . . Before too long, momentum has gathered, and the “project” now is to put it on the suspect. Any information that points to the suspect, no matter how spuriously secured, is somehow obtained; and anything that points away from him is ridiculed and twisted into nothingness. In short, they get wedded to their theory and things inconsistent with their theory are ignored and their tunnel vision means your terrible case…that has hung over your head for usually about 1 year, and cost you $1,000’s and $1,000’s of dollars (which is money you will never see again!) will go to trial and you will get the chance to see what 12 people too stupid to get out of jury duty think …Scary Stuff!

There is no sense in wishing for “how it ought to be.” The simple truth is that if you put 10 people on an island and gave them each 1/10 of the coconuts on that island, within months, the “coconut wealth” would be in the hands of a couple of them. Why? Because, like it or not, some people are smarter, and some will work harder. Thus has it always been, thus shall it always be. Simple observation confirms this.

This seems so obvious as to be axiomatic. I know it makes liberals howl to see it in print, but there you have it. Here are some hints on how to sound more like a liberal:

1. Call the government usurping people’s money an “investment” and pretend no one knows it’s really a tax.
2. Call a full-term, unborn human a “clump of cells” and pretend no one knows it’s really a baby.
3. Call the “fairness doctrine” a protection of free speech, and pretend no one knows it’s exactly the opposite.
4. Call the filibuster a “threat to democracy” and pretend no one remembers how fond you were of during the Bush presidency.
5. Call abstinence “useless in preventing pregnancy” and pretend no one knows how breathtakingly stupid you are.
6. Build an entire economic platform on “soaking the rich” and pretend no one knows that by rich, you mean anyone better off than you.

Finally, since the very act of being a liberal will make you hackneyed, trite and laughable, find a post somewhere like Oregon Live you can just imitate and pretend no one notices you are, well….a liberal.

Of course if you really want to be a liberal you have to be out of your mind. Tomorrow is Tea Party Day and if you are a Marxist lefty then I’m sure you’re perplexed at this grass roots revolution that will put you on the scrapheap of history, and prove once and for all, that your Marxist ideology is, has, and always will be a failure.

If you knew anything about the Tea Party People, you’d know that are non-violent, peaceful people who value the US Constitution, and are willing to stand up in opposition to a verminous Obama Administration that threatens our rights and liberties. If they are “wailing”…it is their right to do so in defense of liberty.
Dissent is part of our American way, as long as it is peaceful and doesn’t interfere with the rights of others.
